GOLDEN EDGE ONLINE PLATFORM
TERMS AND CONDITIONS
INTRODUCTION
Golden Edge Online Platform, also referred to as the “app”, is owned and operated in whole by Golden Edge, The Golden Edge Online Platform is a service designed to cater to current and future entrepreneurs and owners of small and medium sized businesses on a global scale as well as entities and individuals pursuant of seeking investment opportunities in relation to such small and medium sized businesses. The terms and conditions herein govern the end user’s engagement with Golden Edge as well as its use of the Golden Edge Online Platform. The usage of this app, in whole or in part serves to confirm acceptance of all terms and conditions stipulated herein.
The terms and conditions herein incorporate all terms and conditions together with all privacy policies provided by Apple and / or Android. In the event of any conflict between the terms and conditions herein and the terms and conditions as well as privacy policies provided for by Apple and / or Android, it is agreed that the terms and conditions stipulated herein will prevail. It is agreed that the terms and conditions stipulated herein may be amended from time to time and the end user is obligated to familiarise themselves with such changes as they shall be bound by same. The continued use of the Golden Edge Online Platform serves as confirmation of the end user’s acceptance of all terms and conditions and amendments thereof.
PERMITTED USAGE OF ONLINE PLATFORM
The end user agrees to make use of the app and services thereof for lawful purposes only and that breach of this clause shall result in the immediate termination of the account in question together with the end user being personally banned from creating any future accounts or from utilising any services provided by virtue of the use of the app.
INTELLECTUAL PROPERTY AND COPYRIGHT
Any and all visual effects and assets displayed throughout the app relating to that of Golden Edge, including its name, logo, slogan, etc, are considered the intellectual property of Golden Edge and the use of such intellectual property or any imitation or copy thereof by any 3rd party for any reason whatsoever is prohibited without first having obtained prior written consent from Golden Edge.
Other 3rd party names, logos, slogans, etc may be considered the intellectual property of the respective 3rd parties utilising same within the app and the use of such intellectual property or any imitation or copy thereof by any other 3rd party for any reason whatsoever is prohibited without first having obtained prior written consent from owner of such intellectual property.
Golden Edge bears no responsibility for any copyright infringement that may arise from the use of the app as a result of the conduct of any 3rd parties.
PROVISION OF INFORMATION
The end user warrants that any and all requested information provided to Golden Edge shall be comprehensive, accurate and up to date. Failure to furnish Golden Edge with comprehensive, accurate and up to date information when requested to do so may result in immediate termination of the account.
3RD PARTY DATA CHARGES AND COSTS
The use of this app may be result in additional data charges levied by the end user’s internet service provider or mobile network operator and that such additional data costs and charges are not the responsibility of Golden Edge. Any such additional costs and charges shall be for the account of the end user.
USER EXPERIENCE
Golden Edge intends on constantly evolving and updating the Online Platform and thus the app may change from time to time, both visually as well as functionally. Such changes to the Online Platform may result in unplanned delays, inconsistencies, errors, inaccuracies, and limited functionality which Golden Edge will endeavour to rectify at its earliest convenience. Golden Edge shall not be responsible for any damages, losses, inconveniences, etc. experienced by the end user as a result of this.
PASSWORD PRIVACY AND BURDEN OF SECURITY
The end user warrants that it shall endeavour to keep its password associated with its Golden Edge Online Platform private and that it shall not disclose such its password to any third party. The end user must, in the event that such password becomes known to any third parties, immediately inform Golden Edge and change its password so as to maintain safety and security. Golden Edge shall not be liable for any misuse of the app or conduct by a third party using the account of the end user as a result of having access to the end user’s password. Failure to ensure that one’s password remains safe and secure may result in immediate termination of the account.
SUSPENSION AND TERMINATION
Golden Edge reserves the right to suspend and / or terminate the account of the end user at any time, for any reason it may deem fit, with no prior notice being given to the end user.
The end user may make written request to Golden Edge if it so wishes to have its account voluntarily terminated.
DISCLAIMER AND LIMITATION OF LIABILITY
The end user agrees that Golden Edge, its, associated companies and / or entities, agents, partners, affiliates, suppliers and any and / all of its stakeholders shall not, and will not be held liable for any direct or indirect losses or damages sustained by the end user and / or its associated entities or individuals, as a result of the use of the Online Platform.
The end user acknowledges that it makes use of the Golden Edge Online Platform and offered services on its own accord and at its own risk.
ACCESS TO INFORMATION AND DATA
Golden Edge, being the owner and administrator of the Online Platform, reserves the right to access and analyse any and all information and data created and / or transferred to the servers associated with the Online Platform. Such information may include but is not limited to user data, geographical data, and any other information that may exist on the associated servers.
GOVERNING LAW
All terms, conditions and provisions contained herein are governed in accordance with the laws of the United Arab Emirates. Golden Edge reserves the right to initiate legal action against the end user and approach an applicable Court in the event of any transgression of such terms, conditions and provisions which result in damages or losses being sustained by Golden Edge.
VARIATION AND AMENDMENT TO TERMS AND CONDITIONS
Golden Edge reserves the right to amend the terms and conditions contained herein from time to time without prior notice to the end user. Such amendments to the terms and conditions shall be communicated to the end user. The continued use of the Online Platform constitutes acceptance of the amended terms and conditions.
